Simon Schaffer has published a constructivist analysis of the acceptance of Newton’s theory of color that focuses on Newton’s experiments, the continual controversies over them, and his power and authority. In this article, I show that Schaffer’s account does not agree with the historical evidence. Newton’s theory was accepted much sooner than Schaffer holds, when and in places where Newton had little power; many successfully repeated the experiments and few contested them; and theory mattered more than experiment in acceptance. I (...) also present an alternative account of the acceptance of Newton’s theory that shows that, despite criticism when it was first published in 1672, the theory, or parts of it, gradually came to be accepted by mathematical scientists—including Huygens and Leibniz—and Scottish natural philosophers by the time of the publication of the Opticks in 1704. On the Continent, it was coming to be accepted within a decade or so after its publication, that is, before 1716, when Newton replied to a challenge, purportedly by Leibniz, that Schaffer sees as the crucial conflict that at last gave Newton’s experiments their authority. The 300th anniversary of the publication of Isaac Newton’s Opticks in 1704 provides an occasion to review the history of its composition and publication. As a preliminary to presenting that history, Newton’s attitude to publication and response to criticism are examined. Newton’s clashes with Hooke and his presumed role as the cause of the delay in the publication of the Opticks until after his death are also scrutinized. Rather than simply presenting Newton and Hooke as quarrelsome, which they indeed were, (...) they are presented as rivals to be England’s leading optical authority. Although Newton announced his intention to publish a book very much like the Opticks in the winter of 1675–76, he did not begin to write it until 1687. It was composed in various stages, including new experimental investigations, by 1692, except for the part on diffraction. A planned, but unfulfilled, revision of the part on diffraction was responsible for delaying its publication for a number of years. (shrink)

BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. Until international ethical standards are transparently met, sanctions should remain. (shrink)

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

The concept of animal personality is based on consistent individual differences in behaviour, yet little is known about the factors responsible for such variation. Theory based on sex-specific selection predicts sexual dimorphism in personality-related traits and, in some cases, differences in trait variances between the sexes. In this study, we examined the sources of individual variation for boldness behaviour in guppies (Poecilia reticulata). We first demonstrated heightened boldness expression in males relative to females across feral wild types, artificially selected domestic (...) ‘designer’ guppies, and putative hybrids of the two. Boldness and body size covaried at the strain level but were not associated among individuals within strains. We also found high and repeatable behavioural differences among individuals (0.40 > intraclass r > 0.60) in all sex/strain groups except hybrid strain females. However, there was no evidence for the heightened inter-individual male variance anticipated for personality traits subject to certain forms of directional sex-specific selection. Domestic fish were boldest overall, and indicated the largest sex difference, which is consistent with genetic linkage between boldness and male ornamental colouration. Consistently high intrinsic variation in boldness behaviour, which extends to inbred domesticated fish, may in part underpin the invasive potential of this species. (shrink)

The aim of the present research was to develop a difficulty model for logical reasoning problems involving complex ordered arrays used in the Graduate Record Examination. The approach used involved breaking down the problems into their basic cognitive elements such as the complexity of the rules used, the number of mental models required to represent the problem, and question type. Weightings for these different elements were derived from two experimental studies and from the reasoning literature. Based on these weights, difficulty (...) models were developed which were then tested against new data. The models had excellent predictive validity and showed the relative influence of rule based factors and factors relating to the number of underlying models. Different difficulty models were needed for different question types, suggesting that people used a variety of approaches and, at a wider level, that both mental models and mental rules may be used in reasoning. BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. The concept of bodily health is problematic for mechanists like Descartes, as it seems that they need to appeal to something extrinsic to a machine, i.e., its purpose, to determine whether the machine is working well or badly, and so healthy or unhealthy. I take issue with this claim. By drawing on the history of medicine, I suggest that in the seventeenth century there was space for a non-teleological account of health. This article concerns the ongoing neo-logicist program in the philosophy of mathematics. The enterprise began life, in something close to its present form, with Crispin Wright’s seminal [1983]. It was bolstered when Bob Hale [1987] joined the fray on Wright’s behalf and it continues through many extensions, objections, and replies to objections . The overall plan is to develop branches of established mathematics using abstraction principles in the form: Formula where a and b are variables of a given type , (...) Σ is a higher-order operator denoting a function from items of the given type to objects in the range of the first-order variables, and E is an equivalence relation over items of the given type. In what follows, I will sometimes omit the initial quantifiers.Frege [1884, 1893] himself employed three abstraction principles. One of them, used for illustration, comes from geometry: "The direction of l1 is identical to the direction of l2 if and only if l1 is parallel to l2."Call this the direction principle. During the century before its final evacuation in 1930 the population of St Kilda declined from over 100 to 36. While undoubtedly emigration and natural disasters played a part in this depopulation, ongoing processes were also important. In particular, replacement levels were never sufficient to maintain a constant population size. In the early part of this period the main factor responsible was heavy neonatal mortality, almost all from tetanus (), but latterly the fertility of those who survived was low, even (...) though mortality rates had declined. In part at least, this decline in fertility could be ascribed to a lower frequency of marriage—a phenomenon seen elsewhere in the Outer Hebrides during the latter part of the 19th century. (shrink)

Several quantitative studies (e.g. Kidd & Castano, 2013a; Djikic et al., 2013) have shown a positive correlation between literary reading and empathy. However, the literary nature of the stimuli used in these studies has not been defined at a more detailed, stylistic level. In order to explore the stylistic underpinnings of the hypothesized link between literariness and empathy, we conducted a qualitative experiment in which the degree of stylistic foregrounding was manipulated. Subjects (N = 37) read versions of Katherine Mansfield's (...) 'The Fly', a short story rich in foregrounding, while marking striking and evocative passages of their choosing. Afterwards, they were asked to select three markings and elaborate on their experiences in writing. One group read the original story, while the other read a 'non-literary' version, produced by an established author of suspense fiction for young adults, where stylistic foregrounding was reduced. We found that the non-literary version elicited significantly more (p < 0.05) explicitly empathic responses than the original story. This finding stands in contradiction to widely accepted assumptions in recent research, but can be assimilated in alternative models of literariness and affect in literary reading (e.g. Cupchik et al., 1998). We present an analysis of the data with a view to offering more than one interpretation of the observed effects of stylistic foregrounding. (shrink)

In two experiments we tested the hypothesis that the mechanisms that produce belief bias generalise across reasoning tasks. In formal reasoning (i.e., syllogisms) judgements of validity are influenced by actual validity, believability of the conclusions, and an interaction between the two. Although apparently analogous effects of belief and argument strength have been observed in informal reasoning, the design of those studies does not permit an analysis of the interaction effect. In the present studies we redesigned two informal reasoning tasks: the (...) Argument Evaluation Task (AET) and a Law of Large Numbers (LLN) task in order to test the similarity of the phenomena concerned. Our findings provide little support for the idea that belief bias on formal and informal reasoning is a unitary phenomenon. First, there was no correlation across individuals in the extent of belief bias shown on the three tasks. Second, evidence for belief by strength interaction was observed only on AET and under conditions not required for the comparable finding on syllogistic reasoning. Finally, we found that while conclusion believability strongly influenced assessments of arguments strength, it had a relatively weak influence on the verbal justifications offered on the two informal reasoning tasks. Adults are skilled at using language to construct/negotiate identity and to signal affiliation with others, but little is known about how these abilities develop in children. Clearly, children mirror statistical patterns in their local environment (e.g., Canadian children using zed instead of zee), but do they flexibly adapt their linguistic choices on the fly in response to the choices of different peers? To address this question, we examined the effect of group membership on 7‐ to 9‐year‐olds' labeling of objects in (...) a trivia game, exploring whether they were more likely to use a particular label (e.g., sofa vs. couch) if members of their “team” also used that label. In a preregistered study, children (N = 72) were assigned to a team (red or green) and were asked during experimental trials to answer questions—which had multiple possible answers (e.g., blackboard or chalkboard)—after hearing two teammates and two opponents respond to the same question. Results showed that children were significantly more likely to produce labels less commonly used by the community (i.e., dispreferred labels) when their teammates had produced those labels. Crucially, this effect was tied to group membership, and could not be explained by children simply repeating the most recently used label. These findings demonstrate how social processes (i.e., group membership) can guide linguistic variation in children. (shrink)

To help infer the meanings of novel words, children frequently capitalize on their current linguistic knowledge to constrain the hypothesis space. Children's syntactic knowledge of function words has been shown to be especially useful in helping to infer the meanings of novel words, with most previous research focusing on how children use preceding determiners and pronouns/auxiliary to infer whether a novel word refers to an entity or an action, respectively. In the current visual world experiment, we examined whether 28‐ to (...) 32‐month‐olds could exploit their lexical semantic knowledge of an additional class of function words—prepositions—to learn novel nouns. During the experiment, children were tested on their ability to use the prepositions in, on, under, and next to to identify novel creatures displayed on a screen (e.g., The wug is on the table), as well as their ability to later identify the creature without accompanying prepositions (e.g., Look at the wug). Children overall demonstrated understanding of all the prepositions but next to and were able to use their knowledge of prepositions to learn the associations between novel words and their intended referents, as shown by greater‐than chance looks to the target referent when no prepositional phrase was provided. Generally speaking, the two Summae of St. Thomas, long available in English translation, contain all that is (...) most personal and most profound in his philosophical thought. Nonetheless, it is quite impossible to get a fully adequate conception of St. Thomas' place in the history of western thought from a consideration of his theological writings alone. Hence, by translating St. Thomas' Commentary on the Metaphysics of Aristotle into English, Professor J. P. Rowan has provided the non-Latin reading student of the history of philosophy an invaluable service. For it is in his r61e as Aristotelian commentator that we see St. Thomas creating for the Schoolmen a version of Aristotle which served to render the Stagirite's thought into terms which became fundamental to the philosophical defense of Christianity. Further, by keeping in mind the fully-developed notions of St. Thomas on the existence of God and the nature of being as these are given us to understand in the Summae, the reader becomes better enabled, by a critical reading of Thomas' Commentary, to grasp the sense in which the Saint's theological writings are said by his enthusiasts to represent a "completing" and "perfecting" of Aristotle's thought. Professor Rowan's translation is based upon the Turin, 1950, edition of R. M. Spiazzi. This edition is itself fundamentally the older edition of M. R. Cathala, containing but few emendations. Although the translator was obliged to check Spiazzi occasionally against the Parma and Viv6s editions of Thomas' Opera Omnia, the usefulness of such consultation was, as Professor Rowan himself states, "limited inasmuch as both the editions of Viv~s and that of Cathala use Parma as their basic text" (p. vii). Further, since the edition from which he worked was not critical, Professor Rowan found it necessary in some instances to himself emend the reading of the Spiazzi text. However, where such alterations were made, and where indeed they were not obviously required, Professor Rowan indicated his iustification for the change in a footnote. It is unfortunate that no critical edition of Thomas' work was available to his translator; still, although a final evaluation of his emendations must, of course, attend the future appearance of a critical edition of Thomas' work, so far as we were able to judge, Professor Rowan's 250 HISTORY OF PHILOSOPHY changes were in all instances quite reasonable and well ]ustified. Professor Rowan has wisely included a translation of that version of the Aristotelian text upon which St. Thomas (in all probability) based his commentary. As this Latin version frequently departs from such currently available English translations as those of W. D. Ross, H. Tredennik, and others which are based upon Greek sources, a good deal of confusion as to Thomas' actual point of departure would have been introduced had this inclusion not been made. The general value and utility of Professor Rowan's work is further increased by his footnoted indications of the more important variations obtaining between the Greek text (as given in Bekker), and the Latin version employed by St. Thomas. For the reader who wishes to compare the Latin version, the Greek text, and the English translations, Professor Rowan has provided the standard Bekker reference numbers at the beginning of each of Thomas' Lectiones. To further simplify the whole matter of reference and cross-reference, Professor Rowan has used the letter C, followed by a numeral, to designate sections of Thomas' Commentary. These sections are the same as those established originally by Cathala. Numbers not preceded by C designate the appropriate sections of the Latin version of Aristotle's text, and correspond with those given by Spiazzi in his revision of the Cathala edition. Solov'ev on "The Historical Tasks of Philosophy" [Istoricheskie dela filosofii] was given by the young privat-docent on November 20, 1880 at St. Petersburg University; the text of the lecture was published in the periodical Russkaia mysl' soon thereafter. The lecture prepared the way for two parallel courses: a course in metaphysics at the university and a course in the history of ancient philosophy in the Advanced Women's Courses of K. N. Bestuzhev-Riumin. It is clear from (...) the text of the lecture how important a role Solov'ev's simultaneous and mutually related pursuits in metaphysics, the history of philosophy, comparative mythology, and the history of religion played in his early works. The emergence of Latin monks, and then the spread of the monastic orders of the Catholic Church in Rus-Ukraine occurred in the conditions of political-religious transformations of the nineteenth century. Acceptance of baptism from Byzantium did not mean separation from Rome. The Eastern and Western churches were still in unity at that time. The Pope remained the formal head of all Christianity. In 988, as the Nikon Chronicle attests, the ambassadors from Rome and the relics of the saints were brought (...) to the Prince of Kiev during his march to Korsun. It was about the relics of St. Clement, the Pope, found by Cyril and Methodius in the same Korsun on his return from a missionary journey to Khazaria. Two years earlier, according to a chronicle, Vladimir had received ambassadors from Rome who had invited him to adopt Christianity in Latin. Etienne Gilson Reason and Revelation in the Middle Ages, first delivered as the Richard Lectures in 1937, was published in 1938 and became an immediate success. Not only does it contribute to a major question of debate in Christian, Jewish, and Islamic philosophy and religion in the medieval period but it also insists on the validity of truth obtainable through reason as well as revelation, on rational argument alongside religious faith. This message is as important in the twenty-first century as (...) it was in the fourth century of the young Augustine, the thirteenth of St Thomas Aquinas, and the twentieth of the mature Gilson. The major advantage of STS is the kind of teaching it allows and demands. Twelve middle school teachers who were enthused with STS teaching selected two sections for a research study. One section was the experimental STS section; the other followed the course syllabus and textbook closely. The major findings indicate the advantages for STS as a teaching approach. Students at the STS approach learned as many science concepts as students who were taught such concepts directly. But the students in (...) the STS sections were superior in all other aspects, including understanding and use of 14 process skills, use of creative thinking skills, development of more positive attitudes, better ability to apply and connect ideas and skills to other situations, and developing a better understanding of the nature and history of science. Burt (bio)In May 1949, a French Court of Appeals reversed an 1857 decision condemning six poems from Les fleurs du mal for obscenity, in a signal case of a public lifting of a ban against some lyric poems. 1 Among the several interesting features of this case not the least is the decision to proceed against the (...) work in the first place. For lyric poetry does not appear an attractive target for censorship. Its subject matter and formalism remove it far enough from the experience of most readers that Gustave Flaubert, fresh from his troubles with the court over Madame Bovary, could express his surprise at the government’s attack: “This is new,” he wrote to Baudelaire, “this pursuit of a volume of verse.” While Flaubert’s comment was in point of fact inaccurate, he puts his finger on a problem worth considering. 2 Here we have a work that must seem naturally exempt from state intervention, by virtue of a deliberate retreat from risky political subjects, and it nonetheless did get censored by the state. Can anything be learned about “normal” state censorship from this exceptional case? [End Page 19]A key factor in the government’s decision to pursue the book, according to the prosecutor Pinard, was that these poems would prove accessible to a large audience: 3 “An immoral book that had no chance of being read or understood would not be pursued” [1208], he states. In his argument, as in the judgment by the court that the condemned poems “lead necessarily to the exciting of the senses by a coarse realism offensive to modesty” [1182], the assumption is that the work is extraordinarily available, its pictures immediately referable to ordinary experience. In the six condemned poems, language is judged to be not a veil but a tool, and a sex tool at that. “Despite an effort of style” [1182], the poetic situation—in most of the poems that of the boudoir—is painted in a language insufficiently flowery. 4A further interesting feature in the case is that when it comes up again, under DeGaulle’s Fourth Republic, the court summarily dismisses the 1857 judgment of coarse realism as just one possible interpretation, and a forced one at that. ABSTRACT We are interested in the case of Friedrich Christoph Mayer, who in the 1720s, while at the Imperial Academy of Sciences in St. Petersburg, developed a system of the aurora borealis, as well as a mathematical method for calculating the height of the aurora from the geometrical characteristics of the auroral arc. Mayer, encountering a major contradiction in his system which placed the aurora at the height of the clouds, whereas his mathematical method led to an altitude a hundred (...) times higher, never applied his method to concrete cases to deduce the height of the aurora, and quickly lost interest in their detailed description, a task that was nevertheless assigned to him at the St. Petersburg Observatory. Jean-Jacques Dortous de Mairan suggests that Mayer’s abandonment was due to his lack of confidence in observations. We set Mayer’s case against that of Leonhard Euler who, working with Mayer and being aware of the great height of the aurora, later developed a system of the aurora borealis that was compatible with the observational fact. We put forward possible hypotheses to explain Mayer’s disinterest in observing the aurora and in the mathematical method he himself had developed. (shrink)

Apart from the names of Jan Baudouin de Courtenay (1845-1929), Mikołaj Kruszewski (1851-1887), and, later, Jerzy Kuryłowicz (1895-1978), Polish linguists and Polish linguistics generally have been little known in the West. The first two were mentioned with approval by Saussure in an unpublished paper, and this reference was picked up by Roman Jakobson and others many years later. Kuryłowicz, for his part, made himself well known in the West through his important work as Indo-Europeanist, even Semiticist, and as a general (...) linguist. The present volume is a first attempt to broaden the perspectives on the Polish contribution to linguistics both inside and outside of Poland during the past centuries. Specialists in their respective fields contributed chapters on the origins and development of general linguistics (Z. Wąsik), applied linguistics (F. Grucza), lexicology (T. Piotrowski), dialectology (St. Gogolewski), and onomastics (S. Gala), followed by five chapters presenting the theories of the arguably most remarkable Polish linguistic thinkers, from Baudouin de Courtenay (A. Adamska-Sałaciak), Kruszewski (F. M. Berezin), and Kuryłowicz (W. Smoczyński) to Mikołaj Rudnicki (1881-1978) and Ludwik Zabrocki (1907-1977) (both written by J. Bańczerowski). Detailed individual bibliographies, a full index of names (with life dates of Polish linguists from the Renaissance to the present day), and a thorough index of subjects and terms make this volume an important reference tool for anyone wishing to acquaint himself with the rich heritage of Polish linguistic thought. In Republic VI 508e-9b Plato has Socrates claim that the Good is the cause (αίτίαν) of truth and knowledge as well as the very being of the Forms. Consequently, as causes must be distinct from and superior to their effects, the Good is neither truth nor knowledge nor even being, but exceeds them all in beauty (509a), as well as in honour and power (509b). No other passage in Plato has had a more intoxicating effect on its readers. To take (...) just one example, James Adam was moved to quote St. Paul when he remarked about this passage that, 'it is highly characteristic of Plato's whole attitude that he finds the true keystone of the Universe — the ultimate fountain from which both Knowledge and Existence flow — in no cold and colourless ontological abstraction, like Being, but in that for which "all creation groans and labours". John Stuart Mill's On Liberty is commonly viewed as the classic defense of individual liberty, (...) and Mill himself as the grandfather of modern liberalism. In John Stuart Mill on Liberty and Control Joseph Hamburger seeks to dislodge this orthodox interpretation [End Page 308] of Mill. As the title of the work suggests, Hamburger, who died shortly before this work came to press, seeks to convince the reader that a proper understanding of Mill's account of individual liberty needs to be nuanced by an appreciation of those substantial controls that Mill was willing to place upon individuals.Hamburger suggests that the association of Mill with modern liberalism results from viewing the arguments presented in On Liberty in isolation from the context in which they were written. Hamburger argues that Mill's real purpose in writing On Liberty is neither self-evident nor is it one that is easily assimilated to modern libertarian ideals. Hamburger interprets "Mill as making an esoteric argument in On Liberty" (xvii). There are two additional pieces that Hamburger claims one needs in order to properly decipher the puzzle, and thus grasp the true import of Mill's claims concerning liberty. First, Hamburger argues that Mill's desire to bring about cultural reform was dependent upon his rejection of Christianity. Mill's unpublished writings reveal that he was far more antagonistic to the influence of Christian religion than is often recognized. Hamburger argues that for Mill initiating true moral reform depended upon overcoming the old social order of which Christianity was a primary constituent. In order for this to occur, one needed "to establish liberty for those who would implement his plan for moral reformation" (86). Second, Hamburger argues that we must also grasp Mill's view of history if we are to properly understand his project of moral reform and the place of On Liberty within this project. Hamburger claims that Mill's vision of history was strongly influenced by thinkers such as Comte and St. Simon. From them, Mill adopted the view that societies alternate between transitional and natural states, and that the values that are applicable in these states are quite different. Hamburger claims that "Mill easily recognized his own age as being transitional," and that this influences all of his arguments in On Liberty (111).Putting the above together, Hamburger concludes that Mill's arguments are specifically directed toward securing the liberty of those who would combat the influence of Christianity and the old moral order, and that "the liberty recommended in On Liberty was especially valued because it would hasten the undermining of old doctrines and institutions which occurred in transitional periods" (212). Hamburger argues that the liberty that Mill meant to secure in this work was not intended to apply equally to all persons or in all periods. Thus, Hamburger argues that Mill was quite willing to advocate strong forms of social control in other contexts.The latter claim, which Hamburger argues provides a more coherent interpretation of On Liberty, does not necessarily follow from Mill's view of religion and history. Here, I think there is room for two distinct judgments regarding Hamburger's achievement in this book. Hamburger has undoubtedly provided a great service in examining the often neglected areas of Mill's corpus and their relevance to his more prominent works. Philosophers who view On Liberty as an isolated piece of argument, or at best only consider it in relation to Mill's Utilitarianism, thus would profit much from reading this work. I am less convinced, however, of Hamburger's claim that heeding these aspects of Mill's thought will lead one to form a radically different understanding of Mill's claims concerning... (shrink)

Over the last 20+ years, multinational corporations have been confronted with accusations of abuse of market power and unfair and unethical business conduct especially as it relates to their overseas operations and supply chain management. These accusations include, among others, worker exploitation in terms of unfairly low wages, excessive work hours, and unsafe work environment; pollution and contamination of air, ground water and land resources; and, undermining the ability of natural government to protect the well-being of their citizens. MNCs have (...) responded to these accusations by creating voluntary codes of conduct which commit them to specific standards for addressing these issues. These codes are created at both the industry-wide and the individual company level. Unfortunately, these codes have generated little credibility and public trust because their compliance claims cannot be independently verified, and they lack transparency and full public disclosure. In this article, we present a case study of the voluntary code of conduct by Mattel, Inc., the world’s largest toy company. The code, called the Global Manufacturing Principles, confronts the general criticism leveled against voluntary codes of conduct by creating detailed standards of compliance, independent external monitoring of the company’s compliance with its code of conduct, and making full, and uncensored public disclosure of the audit findings and company’s response in terms of remedial action. We present a detailed account of how Mattel’s voluntary code of conduct was created, implemented, and ultimately abandoned over 9 years. We provide an evaluative analysis of the company’s GMP compliance throughout its life span, which suggests a bell-shaped curve, where early top management commitments were met with pockets of resistance from operational groups, who were concerned about balancing GMP compliance efforts with traditional performance criteria. The early stage response from Mattel’s top management was quick and supported with the requisite resources. As a result, the compliance process accelerated, becoming increasingly more robust and effective. The success of code compliance and increased transparency in public disclosure energized field managers with a sense of professional satisfaction and publicly recognized accomplishments. The decline in GMP compliance was equally steep. When all the easily attainable targets had been reached at the company-operated plants, addressing vendor plants’ compliance presented a new set of challenges, which taxed corporate resources and management commitment. It would seem that value-based and ethics-oriented considerations, i.e., doing the right thing for the right reason, were no longer the driving force for Mattel’s management. Mattel did not see any economic benefit from its proactive stance, when competitors did not seem to suffer adverse consequences for not following suit. The final contributing factor to the code’s abandonment was a widely publicized series of product recalls which absorbed top management’s attention. (shrink)

No obstante, los borradores para la Cuestión 23 de la segunda edición de la Óptica (1706) (que se convertiría en la Cuestión 31 en la tercera edición) muestran que con anterioridad había intentado introducir el término para explicar su metodología. Newton (...) introdujo el término por propósitos polémicos para defender su teoría de la gravedad contra las críticas de los cartesianos y los leibnizianos pero, especialmente en los Principia, contra Leibniz mismo. La "filosofía experimental" tiene poco que ver directamente con el experimento, sino que más bien designa de manera más amplia la ciencia empírica. The two interpretations with which La Croix is dissatisfied are 1) the traditional view, which focuses exclusively on St. Anselm’s argument for the existence of God in Proslogion II; and 2) the newer view, championed by Hartshorne and Malcolm, which claims that the argument in Proslogion III supercedes the material in Proslogion II, and is immune from the traditional criticisms. Neither view is correct, La Croix argues, because both assume that Proslogion II and III are logically separable. La Croix places (...) extreme emphasis on Anselm’s assertion in the Preface to the Proslogion that he found "one argument" by means of which he could prove both that God exists and that God possesses the traditional divine attributes. According to La Croix, the overall structure of the Proslogion is to show first, in chapters II and III, that that-than-which-nothing-greater-can-be-conceived exists, and then, in the subsequent chapters, that that-than-which-nothing-greater-can-be-conceived is God, i.e., has the various perfections traditionally ascribed to God. The major task of the book is to argue that neither chapter II nor chapter III contains a "logically complete and independent" argument for the existence of that-than-which-nothing-greater-can-be-conceived, but that taken together, they provide the premises for the propositions that that-than-which-nothing-greater-can-be-conceived exists, cannot be thought not to exist, and cannot not exist. Moreover, La Croix argues that there are no new arguments presented in Anselm’s Reply to Gaunilo: all the apparently new arguments merely make explicit what was left implicit in the Proslogion. As one can guess from these few remarks, there is much to quarrel with in La Croix’s book, but that is a never-ending feature of historical interpretation, and one can certainly sympathize with La Croix’s complaints against the other two interpretations. Unfortunately, La Croix relies on the Charlesworth translation of the Proslogion and the Reply, a translation which is not to be used without great care.—W. E. M. (shrink)

The current COVID-19 crisis may have an impact on the mental health of professionals working on the frontline, especially healthcare workers due to the increase of occupational psychosocial risks, such as emotional exhaustion and secondary traumatic stress. This study explored job demands and resources during the COVID-19 crisis in predicting emotional exhaustion and STS among health professionals. The present study is a descriptive and correlational cross-sectional design, conducted in different hospitals and health centers in Spain. The sample consisted of 221 (...) health professionals with direct involvement in treating COVID-19. An online survey was created and distributed nationwide from March 20 to April 15 which assessed: sociodemographic and occupational data, fear of contagion, contact with death/suffering, lack of material and human protection resources, challenge, emotional exhaustion, and STS. Descriptive findings show high levels of workload, contact with death/suffering, lack of MHPR and challenge, and are moderately high for fear of contagion, emotional exhaustion, and STS. We found an indirect significant effect of lack of MHPR on predicting emotional exhaustion through the workload and on STS through fear of contagion, contact with death/suffering, and workload. To conclude, this study examines the immediate consequences of the crisis on health professionals' well-being in Spain, emphasizing the job demands related to COVID-19 that health professionals are facing, and the resources available in these health contexts. These findings may boost follow-up of this crisis among health professionals to prevent them from long-term consequences. (shrink)

The role of law in bioethics is clear. Laws are enforcement tools: they govern which conditions qualify an individual for disability benefits, or what oversight is necessary for clinical trial protocols, or how patent applications for medical devices should be regulated. I initially studied the law in order to enhance my work in bioethics, but in examining how the law works, I have become convinced that the converse opportunity also exists: there are many areas of law that would benefit from (...) greater input from those in the bioethics community.
